Maryland criminal law process

Any criminal charge is serious. Conviction means a criminal record that follows you the rest of your life, minimizing and eliminating opportunities unimagined in this connected age.  Whether arrested under state or federal criminal law, the arrest process is as follows:

  • Investigation - You may come to the attention of law enforcement through a traffic stop, a 911 call, or through a criminal investigation.  If stopped or detained by police, be polite, provide requested identifying information, and remember to invoke your right to remain silent.
  • Evidence - To search premises, law enforcement must have probable cause to obtain a search warrant.  At a traffic stop, your car can be searched under several conditions—including your arrest, when suspicious objects are in plain view, or you give consent.  Without a valid search warrant, you are not required to consent to search of your premises or your car.
  • Arrest - With probable cause to believe a crime was committed, law enforcement will arrest you. If an officer saw you commit a crime or has good reason to believe you broke the law, you will be arrested without a warrant. If arrested, you have and should exercise the right to remain silent and contact our office.
  • Booking: After arrest you are transported to the local precinct or state police barracks, where you are fingerprinted, photographed, and asked for other identifying background information. Once booked, a Maryland District Court Commissioner determines if probable cause for charges exists, and whether bail is appropriate.
